1. Acceptance of Terms
By accessing or using Ensemble (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a binding legal agreement between you and Ensemble.
2. Description of Service
Ensemble is a concert-first social application that helps you discover and track live music performances. The Service allows you to log concerts you attend, connect with other music enthusiasts, and discover upcoming performances.
3. Account Eligibility and Registration
To use Ensemble, you must:
- Be at least 13 years of age
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Not impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. User Conduct
You agree to use Ensemble in accordance with all applicable laws and regulations. You will not:
- Post, upload, or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Harass, abuse, threaten, or intimidate other users
- Post content that promotes violence, hate speech, discrimination, or self-harm
- Share sexually explicit or suggestive content
- Impersonate others or misrepresent your identity or affiliation
- Engage in spam, phishing, or other deceptive practices
- Use the Service to promote or facilitate illegal activities
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated means (bots, scrapers) to access the Service without permission
5. Zero Tolerance for Objectionable Content and Abuse
Ensemble has zero tolerance for objectionable content and abusive behavior. We are committed to maintaining a safe, respectful community for music enthusiasts.
Prohibited Content includes:
- Violence, graphic content, or threats
- Hate speech, discrimination, or content that targets individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics
- Sexual content, nudity, or sexually suggestive material
- Content promoting self-harm, suicide, or eating disorders
- Harassment, bullying, or intimidation
- Spam, scams, or fraudulent schemes
- Content that infringes on others' intellectual property rights
Reporting and Enforcement
You may report objectionable content or abusive behavior at any time using the in-app reporting feature. We review all reports and take action within 24 hours. When we determine that content violates these standards, we will:
- Remove the offending content
- Eject (permanently ban) the user who posted it
- Report illegal activity to law enforcement when appropriate
For less severe violations, we may issue warnings or temporarily suspend accounts before permanent termination. However, serious violations—including but not limited to violence, hate speech, sexual content, or harassment—will result in immediate removal of content and permanent account termination.
6. Content Ownership and License
Your Content
You retain ownership of all content you post on Ensemble, including concert logs, photos, notes, and comments ("Your Content"). By posting Your Content, you grant Ensemble a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute Your Content as necessary to operate and improve the Service.
Other Users' Content
You may not use, copy, reproduce, distribute, or create derivative works from other users' content without their explicit permission.
Ensemble Content
All materials provided by Ensemble, including the app design, features, text, graphics, logos, and software, are owned by Ensemble and protected by copyright, trademark, and other intellectual property laws.
7. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
8. Concert Data and Venue Information
Ensemble aggregates concert and venue data from various sources. While we strive for accuracy, we do not guarantee that all information is complete, accurate, or up-to-date. You should verify important details (dates, times, ticket availability) directly with venues or official sources.
9. Payments and Subscriptions
Currently, Ensemble is free to use. If we introduce paid features or subscriptions in the future, we will provide clear notice and terms before charging you.
10. Termination
By You
You may delete your account at any time through the app settings. Upon deletion, your account and associated data will be removed in accordance with our Privacy Policy.
By Ensemble
We reserve the right to suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms
- Behavior that harms or could harm other users or the Service
- Suspected fraudulent, abusive, or illegal activity
- Extended periods of inactivity
Upon termination, your right to use the Service will immediately cease.
11. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENSEMBLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers or any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, or other harmful code transmitted through the Service
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted or shared through the Service
12. Indemnification
You agree to indemnify, defend, and hold harmless Ensemble, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your Content
13. Dispute Resolution
These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
14. Changes to Terms
We may modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page and notify you through the app or via email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
